Terms of Use

1. Provider and scope

These Terms of Use apply to the website and services offered under fove.design ("Fove", "we", "us"). The provider is Fabian Kleiser, Schillerstr. 6/5, 71154 Nufringen, Germany. Contact: privacy@fove.design.

Fove provides tools for creating gradients, color palettes, previews, exports, educational content, optional accounts, and saved collections. Public editor and content features can currently be used free of charge. Optional account features are currently free as well. We may introduce paid features, plans, limits, or subscriptions in the future; any paid offer will be presented with its own pricing and contractual information before you buy.

2. Eligibility and accounts

You may use public Fove features without creating an account. If you create an account, you must provide accurate information, keep your credentials secure, and notify us if you suspect unauthorized access. You are responsible for activity under your account.

We may suspend or terminate accounts if necessary to protect the service, other users, or legal rights, for example in cases of abuse, security risk, unlawful use, or material breach of these Terms.

3. Acceptable use

You agree not to misuse Fove. In particular, you must not:

  • use the service for unlawful, infringing, harmful, or abusive purposes;
  • attempt to disrupt, overload, probe, or compromise the service or its infrastructure;
  • circumvent access controls, rate limits, security features, or account restrictions;
  • upload, store, or share content that violates rights of others or applicable law;
  • use automated scraping or extraction in a way that harms service availability.

4. Your content and saved gradients

You remain responsible for names, descriptions, color choices, saved gradient settings, and other content you create or store in Fove. You grant us the rights necessary to host, process, display, and technically operate that content for the purpose of providing the service to you.

Do not store sensitive personal data, confidential third-party information, trade secrets, or content you are not allowed to process in Fove unless you have a suitable legal basis and permission to do so.

5. Exports and design output

You may use gradients, palettes, exported image files, SVG, CSS, and code snippets generated through Fove for personal and commercial design work, subject to these Terms and any rights you or third parties may have in your own input content. Fove does not guarantee that a generated color combination is unique, protectable, accessible for every context, or suitable for a specific legal or brand requirement.

6. Intellectual property

The Fove website, interface, brand, source code, editorial content, documentation, and original design elements are protected by copyright, trademark, and other laws. Except as expressly allowed by these Terms, you may not copy, modify, distribute, or make derivative products from Fove itself.

7. Availability and changes

We aim to keep Fove reliable, but we do not guarantee uninterrupted availability. Features may change, be limited, or be discontinued where reasonably necessary, for example for security, maintenance, legal, operational, or product reasons.

We may use technical logging, security controls, and error monitoring to diagnose faults, prevent abuse, and protect the service. Please do not include sensitive personal data, confidential information, or trade secrets in palette names, collection names, descriptions, or other optional text fields.

8. Free features and future paid features

Fove is currently free to use. If paid features are introduced, the relevant pricing, renewal terms, cancellation rights, payment provider, and consumer information will be shown before a paid contract is concluded. These Terms do not by themselves create an obligation to pay.

9. Liability

Fove is provided with reasonable care. Nothing in these Terms limits liability for intent, gross negligence, injury to life, body, or health, liability under mandatory product liability law, or other liability that cannot legally be limited.

In cases of simple negligence, we are liable only for breach of essential contractual obligations and only for typical, foreseeable damage. Essential contractual obligations are obligations whose fulfilment enables proper use of the service and on which users may regularly rely.

10. Consumer rights

Nothing in these Terms affects mandatory consumer protection rights available to you under applicable law. Because Fove currently does not sell paid digital services through this website, statutory withdrawal information for paid contracts is not included here. It will be provided before any paid consumer contract is concluded.

11. Governing law

These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer and mandatory consumer law in your country of residence gives you stronger protection, those mandatory rules remain unaffected.
